Exclusive commercial representation
In its initial version, the law of July 29, 1991, relating to competition and prices did not include any ban on exclusive commercial representation contracts. This ban was introduced by the law of April 24, 1995 which inserted a new paragraph into article 5 of the 1991 law under which: “Concession and exclusive commercial representation contracts are prohibited in all cases… Any commitment, agreement or contractual clause relating to one of the practices prohibited under this article is automatically void.
